Terms & Conditions
These terms set out the basis on which Suwan Counsel provides legal services relating to inheritance and estate matters. Please read them carefully. By engaging our services, you indicate that you understand and agree to these arrangements.

Definitions
"Agreement" means these Terms & Conditions together with any engagement letter or service agreement entered into between Suwan Counsel and a client.
"We / Us / Our" refers to Suwan Counsel, an inheritance law practice situated at 8 Si Phum Road, Mueang, Chiang Mai 50200, Thailand.
"Client / You / Your" means any individual or entity that engages Suwan Counsel for legal services or makes use of this website.
"Services" means the inheritance and estate legal services we offer, including Will & Wishes Review, Estate Arrangement Planning, and Probate & Dispute Support, as described on our website and in individual engagement letters.
"Content" means all text, documents, advice, plans, drafts, and other materials produced by Suwan Counsel in connection with the Services.
"Website" means the Suwan Counsel website accessible at suwancou.pro and its associated pages.
Acceptance of Terms
By submitting an enquiry, signing an engagement letter, or making payment to Suwan Counsel, you confirm that you have read, understood, and agreed to these Terms & Conditions.
Our services are available to individuals aged 18 years and above who have the legal capacity to enter into a binding agreement under Thai law. If you are acting on behalf of another person — for example, as a power of attorney holder — you represent that you have the authority to bind that person to these terms.
If you do not agree to any part of these terms, please do not proceed with an engagement. We are happy to discuss any question before a formal arrangement is made.
Service Description
Suwan Counsel provides specialist inheritance and estate legal services in Thailand, including the following:
- Will & Wishes Review — a careful review or preparation of a will in accordance with Thai law, with plain-language guidance on the essentials.
- Estate Arrangement Planning — thoughtful planning to arrange an estate in line with a client's intentions, including a written plan and supporting documentation.
- Probate & Dispute Support — steady support through the probate process, including calm advisory assistance where an inheritance matter is contested.
Services are provided to clients in Thailand and to overseas individuals with estates or interests subject to Thai jurisdiction. We do not accept enquiries that fall outside the scope of Thai inheritance law.
The specific scope of work for each engagement will be set out in an engagement letter signed by both parties before any work begins.
Client Responsibilities
To allow us to serve you well, we ask that you:
- Provide accurate, complete, and timely information relevant to your matter.
- Inform us promptly of any change in circumstances that may affect your instructions.
- Respond to our requests for documents, decisions, or clarifications within reasonable timeframes.
- Use the Website and our communications only for lawful purposes and in a manner consistent with these terms.
- Refrain from misrepresenting your identity, authority, or the nature of your matter.
Suwan Counsel cannot be responsible for delays or outcomes that arise from incomplete or inaccurate information provided by the client.
You agree not to attempt to circumvent, damage, or interfere with the operation of our Website, and not to use it to transmit any harmful, abusive, or unlawful content.
Intellectual Property
All materials on the Suwan Counsel Website — including text, layout, branding, and design — are the property of Suwan Counsel and are protected under applicable Thai and international intellectual property law.
We grant you a limited, non-exclusive, non-transferable licence to access and read the Website for your personal, non-commercial use. This licence does not extend to copying, reproducing, or redistributing any part of the Website without our written consent.
Documents, plans, and written advice produced specifically for a client engagement remain the intellectual property of Suwan Counsel until fees are settled in full, at which point ownership of those documents transfers to the client for the purposes of their personal use.
Client documents and information you provide to us remain your property. We will handle them in accordance with our Privacy Policy and the obligations of confidentiality that apply to legal practice.
Fees & Payment
Our service fees are quoted in Thai Baht (฿). The indicative fees for each service are set out on our Website, and the confirmed fee for your engagement will be stated in the engagement letter.
Fees are payable as set out in the engagement letter, which typically requires a deposit before work begins and settlement of the balance upon completion. For the Probate & Dispute Support service, fees are provided as a clear cost outline at each stage of the matter.
Payment may be made by bank transfer to the account details provided in your engagement letter. We do not accept cash for amounts above the threshold set by Thai anti-money-laundering regulations.
If a matter is concluded or withdrawn before completion, fees will be calculated on the basis of the reasonable time and work already carried out. Any deposit paid will be applied toward the amount owing.
We do not offer refunds once legal work has been completed or substantially commenced. If you have concerns about fees at any stage, we encourage you to speak with us directly — we would rather address any question early.
Service-Specific Terms
Will & Wishes Review
The scope of review or drafting will be agreed before work begins. Any will prepared by Suwan Counsel reflects the instructions and wishes you have provided. Suwan Counsel cannot be responsible for the legal validity of arrangements that depend on assets or circumstances not disclosed to us, nor for decisions made after the will is finalised without our involvement.
Estate Arrangement Planning
The written plan we produce represents our considered guidance based on the information provided. Thai inheritance law is subject to change, and the plan should be reviewed periodically. We recommend reviewing estate arrangements at least every three to five years or after a significant change in family or financial circumstances.
Probate & Dispute Support
The duration and cost of probate and dispute matters can vary considerably depending on the complexity of the estate and the positions of other parties. We will provide a clear cost outline at each stage, and we will not proceed to the next stage without your agreement. Advisory support in contested matters is provided to help you make well-considered decisions; outcomes in contested proceedings cannot be stated in advance.
Confidentiality
We treat all information shared with us in the course of an engagement as strictly confidential. We will not disclose details of your matter to any third party except where required by law or with your express consent.
Disclosure may be required in limited circumstances — for example, to comply with Thai anti-money-laundering obligations, or where a court order compels disclosure. We will inform you of any such requirement where we are legally permitted to do so.

Our legal services are provided with reasonable care and professional skill, but no legal practitioner can confirm a specific outcome in advance of a matter being resolved. Outcomes in inheritance, estate, and probate matters depend on facts, third parties, and judicial decisions that are outside any practitioner's control.
We do not represent that the information on our Website is complete, current, or free from error at all times. We may update or remove content without prior notice.
Limitation of Liability
Suwan Counsel's liability for any claim arising from or relating to our services is limited to the total fees paid by the client for the specific engagement to which the claim relates.
We are not liable for any indirect, consequential, or special losses, including loss of income, loss of opportunity, or losses caused by the actions of third parties such as courts, government offices, or other family members.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, or for any liability that cannot lawfully be excluded under Thai law.
Events beyond our reasonable control — including changes in legislation, court delays, or acts of government — will not give rise to liability on our part, provided we inform you promptly of any such development affecting your matter.
Indemnification
You agree to indemnify and hold harmless Suwan Counsel, its principal, associates, and staff from any claim, cost, or loss — including reasonable legal fees — arising from your breach of these terms, your misrepresentation of facts material to your engagement, or your use of the Website in a manner that is unlawful or that causes harm to others.
Termination
You may end an engagement at any time by giving us written notice. Fees will be calculated on the basis of work already completed and any disbursements incurred.
Suwan Counsel reserves the right to decline or withdraw from an engagement where continued representation would conflict with our professional obligations, where a client has provided materially misleading information, or where fees are not settled as agreed.
Where we withdraw from an engagement, we will provide reasonable notice and return any documents belonging to you promptly, subject to any fees outstanding.
The provisions of these terms relating to confidentiality, intellectual property, limitation of liability, and dispute resolution will continue to apply after any engagement has concluded.
Dispute Resolution
These Terms & Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising from or related to these terms or a service engagement will be subject to the jurisdiction of the Thai courts.
Before initiating formal proceedings, we encourage both parties to first attempt to resolve any concern through direct discussion. If you have a concern, please contact us at [email protected] and we will arrange a meeting or call to address it.
Where a dispute cannot be resolved through discussion within 30 days, either party may refer the matter to mediation through the Thai Mediation Centre before proceeding to litigation. This is not a binding requirement, but we believe that calm dialogue will nearly always produce a better outcome for all concerned.
General Provisions
Entire Agreement. These terms, together with any engagement letter, constitute the entire agreement between Suwan Counsel and the client in respect of the matters they cover, and supersede any prior discussions or correspondence.
Severability. If any provision of these terms is found to be unenforceable, that provision will be read down to the minimum extent necessary to make it enforceable, and the remaining terms will continue in full effect.
Waiver. A failure by either party to exercise any right under these terms does not constitute a waiver of that right.
Assignment. You may not assign your rights or obligations under these terms without our prior written consent. Suwan Counsel may transfer rights and obligations where the practice changes ownership or structure, provided client confidentiality is preserved.
Notices. Notices under these terms should be sent by email or in writing to the addresses set out in the engagement letter or in Section 16 of these terms.
Changes to These Terms
We may update these Terms & Conditions from time to time, and the current version will always be available on our Website. Where changes are material, we will take reasonable steps to draw them to clients' attention.
For ongoing engagements, any change to these terms will not affect agreed engagement letters already in place. For new enquiries, the terms published at the time of engagement will apply.
