Common Questions
Questions we hear most often
If something else is on your mind, please reach out directly — we are glad to help.
Do I need a will if I am a foreigner living in Thailand?
It is strongly advisable. A Thai will covering assets held in Thailand makes the process significantly clearer for your family and reduces administrative delay. Without one, Thai inheritance law applies by default, which may not reflect your intentions.
How long does probate typically take in Thailand?
For straightforward estates, the court process commonly takes between three to six months. More involved matters — particularly where assets are varied or there is any dispute — can extend further. We will give you a realistic picture for your specific circumstances at the outset.
What happens if there is no will and a family member has passed?
Thai law sets out a fixed order of inheritance in the absence of a will. The estate passes to statutory heirs in a defined sequence. We can explain how this applies to your family's situation and help you navigate the administration process calmly and efficiently.
Can disputes about an inheritance be resolved without going to court?
In many cases, yes. Families often reach an agreed arrangement with the help of careful advisory support, which avoids the time and cost of litigation. We will be honest about whether that is a realistic path in your situation, and what each option involves.
How much does it cost, and are fees fixed?
We set out fees clearly before any work begins. Our three services are priced at ฿4,500, ฿10,100, and ฿17,400 respectively. For probate and dispute matters, we provide a clear cost outline at each stage so there are no surprises.
Do you work with Thai and non-Thai clients?
Yes. Suwan Counsel works with both Thai nationals and foreign residents or families in Thailand. Our consultations are conducted in English, and we are familiar with the particular circumstances that arise for mixed-nationality families and expatriates.
